Terms of Service
Effective Date: [Effective Date]
These Terms explain how Oklahoma Estate Finders' website, intake forms, communications, and asset recovery review process work. By using our website or submitting information, you agree to these Terms. If you later sign a separate recovery agreement or authorization, that signed agreement will control the specific recovery services.
1. Acceptance of Terms
By accessing the website, scanning a QR code, submitting a form, communicating with us, or using our services, you agree to these Terms. If you do not agree, you should not use the site or submit information. These Terms may be updated, with the effective date revised.
2. Who We Are
Oklahoma Estate Finders is an independent private asset recovery agency. We are not the Oklahoma State Treasurer, the State of Oklahoma, or any government agency. Our services are separate from any official government unclaimed property process.
3. Free Government Claim Option
You may be able to search for and claim unclaimed property yourself through official government resources for free. Our service is optional and is designed for people who want help reviewing, organizing, documenting, and pursuing a potential claim.
4. Description of Services
Our services include intake review, claim research, contacting potential claimants, reviewing owner/heir/business/entity information, helping prepare claim materials, digital onboarding and e-sign authorization, document collection through secure channels, submission or support of claims where authorized, follow-up with holders, agencies, administrators, or other parties, and communication by phone, text, email, mail, and other lawful methods.
We do not promise guaranteed approval, guaranteed recovery, guaranteed timing, legal outcomes, probate outcomes, or specific dollar amounts unless confirmed.
5. Intake Form Is Not a Contract
Submitting an intake form does not create a signed recovery agreement, agency relationship, power of attorney, or guarantee of recovery. If we determine that we may be able to assist you, we may send separate documents for review and electronic signature.
6. Separate Signed Agreement Controls
If you sign a recovery agreement, fee agreement, authorization, power of attorney, e-sign consent, or similar document, that signed document controls the actual recovery engagement. If there is a conflict between general website Terms and a signed recovery agreement, the signed agreement controls for that claim.
7. Fees and Compensation
Any recovery fee or compensation will be stated in a separate written or electronically signed agreement and will comply with applicable law. No recovery fee is owed merely because you submit an intake form.

8. No Guarantee of Recovery
Asset recovery claims depend on ownership records, government or holder requirements, documentation, competing claims, estate status, identity verification, and other factors outside our control. We do not guarantee that any claim will be approved or paid.
9. User Responsibilities
You agree to provide accurate information, only submit information you are authorized to provide, not impersonate another person, not submit false heirship, ownership, entity, or estate information, keep contact information updated, provide requested documentation through secure channels if later onboarded, review all documents before signing, and consult your own attorney, tax advisor, or probate advisor when needed.
10. Deceased Owners, Heirs, Estates, Trusts, and Businesses
Estate, heir, and business claims may require additional proof. We do not determine legal heirship as a court. We do not provide probate or legal advice. You may need court documents, death certificates, affidavits, letters testamentary, trust documents, entity authorization, or other proof. We may decline or pause a claim if authority is unclear.
11. No Legal, Tax, Probate, Financial, or Investment Advice
Oklahoma Estate Finders is not a law firm unless separately stated by licensed counsel. Nothing on the website is legal, tax, probate, investment, or financial advice. You should consult qualified professionals for legal, tax, or probate questions.
12. Communications Consent
By providing your phone number, email address, mailing address, or other contact information, you authorize Oklahoma Estate Finders and our service providers to contact you regarding your inquiry, potential claim, onboarding, documents, account, and related services. Communications may include phone calls, text messages, emails, voicemails, and physical mail. Where required by law, marketing or automated communications will only be sent with appropriate consent. You may opt out of marketing emails using the unsubscribe link and may opt out of text messages by replying STOP, CANCEL, END, UNSUBSCRIBE, or a similar request.
13. Marketing and Re-Engagement
We may send re-engagement messages about incomplete forms, incomplete onboarding, missing documents, unclaimed property education, related recovery opportunities, service updates, or reminders. We may use CRM and advertising/analytics tools. All marketing emails include an unsubscribe option. All SMS marketing includes opt-out instructions. You can request removal from marketing lists.
14. E-Sign Consent
If you proceed beyond intake, we may ask you to review and sign documents electronically. Electronic signatures and records may have the same legal effect as paper records and handwritten signatures. You may request paper copies or withdraw electronic consent, but doing so may delay or prevent digital processing.
15. Privacy Reference
Your use of our services is also governed by our Privacy Policy, which is incorporated by reference into these Terms.
16. Security and Sensitive Information
Do not submit your full SSN, full government ID images, bank account information, or highly sensitive documents through unsecured public forms. If such information is needed, it will be requested through secure onboarding or another approved secure method. No system can be guaranteed 100% secure. You are responsible for protecting access to your email, phone, and portal account.
17. Third-Party Services
We may use third-party vendors for CRM, email, SMS, call tracking, analytics, advertising, document storage, e-signature, identity verification, payment, mail processing, and claim support. We are not responsible for third-party websites or portals not controlled by us. Links to official government websites are for convenience.
18. Website Use Restrictions
You may not scrape, attack, spam, hack, reverse engineer, or misuse the site; submit false or fraudulent information; interfere with site security; use the site for unlawful purposes; upload malware or harmful files; or impersonate another person.
19. Intellectual Property
Website content, logos, copy, graphics, forms, workflows, and materials belong to Oklahoma Estate Finders or our licensors. You may not copy or use our branding without permission.
20. Disclaimer of Warranties
The site and services are provided "as is" and "as available." We disclaim implied warranties to the maximum extent allowed by law. We do not warrant uninterrupted service, error-free content, or guaranteed recovery.
21. Limitation of Liability
To the maximum extent allowed by law, we limit our liability for indirect, incidental, consequential, special, punitive, lost profit, lost data, or lost opportunity damages. Any direct liability is strictly limited.

22. Indemnification
You agree to indemnify Oklahoma Estate Finders for claims caused by your false information, unauthorized submissions, fraud, misuse of the site, violation of these Terms, or violation of another person's rights.
23. Right to Decline, Pause, or Terminate
We may decline a lead or claim for any lawful reason. We may pause review if documentation is missing, authority is unclear, information conflicts, fraud risk exists, or claim requirements cannot be met. We may terminate site access for misuse.
24. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law rules. Any dispute resolution, venue, arbitration, or class-action waiver language should be reviewed by counsel before publication.

25. Changes to Terms
We may update these Terms from time to time. The updated Terms will be effective when posted. Your continued use of our services means you accept the updated Terms.
